You are strictly prohibited from utilizing the VantixLayer application infrastructure to:
- Spam Transmission: Facilitate or execute unsolicited bulk electronic messages violating CASL, CAN-SPAM, or GDPR.
- Illicit Content: Host, reference, or transmit defamatory, threatening, discriminatory, or unlawful materials.
- Malware Distribution: Disseminate ransomware, trojan horses, viruses, or destructive code structures.
- Deceptive Practices: Engage in phishing, spoofing, identity theft, or misleading communications.
- Infrastructure Disruption: Reverse-engineer, decompile, or launch denial-of-service attempts against VantixLayer.
2. Bandwidth & Visit Fair Use Matrix
To ensure platform stability, subscription tiers are governed by the following monthly operational thresholds. Exceeding these limits requires an immediate tier upgrade:
- Standard Plan ($49/mo): Maximum 50,000 monthly tracked website visits | 20 GB automation data bandwidth.
- Pro Plan ($99/mo): Maximum 250,000 monthly tracked website visits | 100 GB automation data bandwidth.
3. Enforcement Actions
Verified violations of this AUP result in immediate administrative action:
- Suspension: Immediate termination of dashboard access with zero financial refund.
- Reporting: Permanent account deletion and direct disclosure to law enforcement and your connected SMTP network provider.
2. Privacy Policy & PIPEDA Compliance
1. Information Collection & Blesta Tokenization
- Account Data: Legal name, company entity, billing address, and email coordinates.
- Payment Security: Financial data is processed via the Blesta billing platform. No raw credit card details are stored on our servers; all transactions utilize secure, encrypted payment tokens.
- Integration Parameters: Enforced encryption at rest for all inputted third-party SMTP API keys, security tokens, and server credentials.
- Operational Logs: IP addresses, browser strings, and application interactions recorded strictly for diagnostic telemetry.
2. Data Utilization & Processing Boundaries
- Purpose: Information is strictly limited to provisioning software layers, processing payments, and enforcing AUP compliance.
- Zero Monetization: VantixLayer never sells, rents, or monetizes customer subscriber lists or campaign data assets.
- Purge Cycles: Automation logs and webhook payloads pass through transient cloud hosting memory. Delivery diagnostic logs are completely purged from systems on a rolling 30-to-90-day cycle.
3. Statutory Rights (PIPEDA)
In alignment with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), users retain unconditional rights to access, correct, or demand erasure of their personal profiles. Direct all statutory compliance inquiries to our Data Protection Officer at privacy@vantixlayer.com.
3. Anti-Spam Policy
1. Mandatory Campaign Criteria
Every automated sequence routed through the VantixLayer software must rigorously adhere to CASL and international frameworks:
- Verifiable Consent: You must possess documented express or valid implied consent from every recipient profile before firing automated triggers.
- Sender Transparency: Every transmission must explicitly display your legal business identity and a valid physical postal address.
- Instant Unsubscribe: Emails must contain a functional, clear, one-click opt-out mechanism. Opt-out records must update instantly within your connected database, or within a maximum limit of 10 business days.
2. Operational Thresholds & Penalties
- Telemetry Monitoring: System monitors track aggregate bounce metrics and spam complaints.
- Threshold Breaches: If your automated workflows generate complaint rates exceeding 0.1% (1 complaint per 1,000 sent messages) on your external SMTP, automation layer pipelines will be instantly disabled without notice.
4. SLA, Support & Backup Policy
1. Service Level Agreement (SLA)
- Availability Target: VantixLayer guarantees a 99.9% uptime availability metric for core web application routing and automation processing engines, evaluated monthly.
- Exclusions: Excludes planned technical maintenance windows executed during off-peak hours (CST) with 24-hour advance dashboard notification.
- Remedy Metrics: If platform availability drops below 99.9% in a calendar month, clients may claim a pro-rated account credit. Outages stemming from your independent SMTP network (e.g., AWS SES downtime) are completely exempt from remedies.
2. Ticket Response Commitments
Support requests are processed through our ticket queue based on official timelines:
- Technical & Billing Queues: A maximum 24-to-48 hour response time for account issues, plugin errors, billing claims, or enterprise requests during operational business hours.
3. Data Backup Policy & Absolute Liability Disclaimer
- Platform Backup Routines: Automated, encrypted system-wide snapshots are captured daily and retained for a rolling 30-day window purely for primary disaster recovery events (RPO: 24 hours | RTO: 4 hours).
- ABSOLUTE LIABILITY DISCLAIMER: VANTIXLAYER EXECUTES SYSTEM-WIDE BACKUPS SOLELY AS AN INTERNAL INFRASTRUCTURE MEASURE. THE INTEGRITY, COMPLETENESS, AND SUCCESSFUL RESTORATION OF DATA ARCHIVES ARE NOT GUARANTEED. THE CLIENT RETAINS UNCONDITIONAL, SOLE LEGAL AND TECHNICAL RESPONSIBILITY TO INDEPENDENTLY ARRANGE, EXECUTE, AND MAINTAIN COMPREHENSIVE OFFSITE BACKUPS OF ALL WEBSITE FILES, SOURCE CODE, DATABASE INFRASTRUCTURE, AND DIGITAL ASSETS.
- FINANCIAL EXEMPTION: VANTIXLAYER AND SEECONVERSION TECHNOLOGIES ASSUME ZERO FINANCIAL, LOGISTICAL, OR OPERATIONAL LIABILITY FOR ANY DATA ERASURE, SYSTEM CORRUPTION, WORDPRESS INFRASTRUCTURE CRASHES, OR CRITICAL FAILURE OCCURRING DURING THE USE OF THIS APPLICATION LAYER.
